Welcome to Betway. These Terms of Service (the "Agreement" or "Terms") constitute a legally binding contract between you (the "User", "Player", "you", or "your") and Betway Limited, its parent companies, subsidiaries, affiliates, and designated operational partners within the United States (collectively referred to as "Betway", "we", "us", or "our"). This Agreement governs your access to and use of the Betway website, mobile applications, sportsbook platform, real-money casino games, and all related services (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY. By accessing, downloading, registering for an account, or continuing to use the Services, you explicitly acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms, as well as our Privacy Policy and House Rules, which are incorporated herein by reference. If you do not agree with any provision of this Agreement, you must immediately cease all use of the Services and uninstall the Betway application.

1. Eligibility and Account Creation

To lawfully access and utilize the real-money wagering Services provided by Betway, you must satisfy strict eligibility criteria mandated by state and federal law. By attempting to open an account, you represent and warrant that you meet all of the following conditions:

• Age Restriction: You are at least twenty-one (21) years of age. Underage gambling is a criminal offense. Betway utilizes sophisticated third-party identity verification services to confirm the age of all applicants.
• Jurisdictional Limits: You are physically located within the borders of a US state where Betway is licensed and regulated to offer real-money gaming (e.g., New Jersey, Pennsylvania, Michigan). Geolocation software will continuously monitor your physical location while you are logged into the platform.
• Excluded Persons: You are not a "key employee," coach, athlete, referee, or official prohibited by a sports governing body from placing wagers. Furthermore, you are not on any state-sponsored self-exclusion list or involuntary exclusion list.

You are strictly permitted to hold only one (1) Betway account. The creation of multiple accounts, dummy accounts, or accounts created under false identities to bypass limits or claim multiple welcome bonuses is strictly prohibited and will result in the immediate termination of all associated accounts, the voiding of pending wagers, and the forfeiture of all balances.

2. Identity Verification and KYC Protocols

In accordance with the USA PATRIOT Act and various state gaming enforcement regulations, Betway is legally obligated to implement strict Know Your Customer (KYC) and Anti-Money Laundering (AML) protocols. Upon registration, you must provide accurate, current, and complete information, including your full legal name, residential address, date of birth, and the last four digits of your Social Security Number (SSN).

If our automated systems cannot instantly verify your identity, your account will be temporarily restricted. You will be required to securely upload supplemental documentation, which may include a high-resolution photograph of a valid government-issued ID (driver's license or passport) and a recent utility bill or bank statement serving as proof of address. Failure to provide requested documentation within the specified timeframe will result in permanent account closure.

3. Deposits, Withdrawals, and Player Funding

A. Making Deposits

You may fund your Betway account using approved payment methods, which may include credit/debit cards (where legally permitted), ACH/e-Check, PayPal, Venmo, online banking transfers, and the Betway Play+ card. You guarantee that any payment method used belongs to you and is registered in your legal name. The use of corporate cards or third-party payment methods is strictly prohibited.

B. Withdrawals and the Closed-Loop Policy

To combat money laundering, Betway operates a "Closed-Loop" withdrawal policy. This dictates that withdrawal requests must generally be routed back to the exact same payment method used to make your most recent deposits, up to the total amount deposited. Once the deposited amount has been balanced, you may select alternative approved withdrawal methods for your net winnings.

Betway reserves the right to delay the processing of any withdrawal request for up to 72 hours for security auditing, fraud prevention, and gameplay review. In instances of suspected fraud, bonus abuse, or matched betting syndicates, Betway may withhold withdrawals indefinitely pending a full investigation.

C. Chargebacks and Reversals

You agree not to dispute, cancel, or initiate chargebacks on any deposits made to your account without prior consultation with our Customer Support team. If a chargeback occurs, Betway reserves the right to suspend your account, void any winnings generated from the disputed funds, and pursue legal and collection action to recover the owed amounts, including any administrative fees incurred.

4. Sportsbook Betting Rules and Wager Settlement

All sports wagers placed on the platform are governed by the comprehensive Betway House Rules, which outline specific settlement criteria for every sport, league, and bet type. By placing a sports wager, you agree to these House Rules.

• Palpable Errors (Obvious Errors): Betway makes every effort to ensure the accuracy of our odds and lines. However, human or system errors may occur (e.g., odds of +1000 being offered instead of +100, or reversed point spreads). In the event of a Palpable Error, Betway reserves the right to void any affected wagers or resettle the wagers at the correct odds that should have been available at the time the bet was placed.
• Postponements and Cancellations: If a sporting event is postponed, canceled, or abandoned, the settlement of wagers will be determined by the specific sport's House Rules. Generally, if an event is not completed within 48 hours of its scheduled start time, wagers will be voided and stakes refunded.
• Live In-Play Betting: Due to the dynamic nature of live betting, odds fluctuate rapidly. We employ an intentional delay (typically 3-5 seconds) on all live bet placements to ensure fairness and prevent "courtsiding" or data feed exploitation. Betway is not liable for wagers rejected due to odds changing during this delay period.

5. Casino and Live Dealer Rules

When participating in the Betway online casino, you acknowledge that the outcomes of all virtual games (slots, digital table games) are determined by a verified Random Number Generator (RNG). The RNG is independently audited and certified by approved third-party testing laboratories (such as eCOGRA or GLI) to ensure fairness and compliance with state regulations.

Malfunction Voids All Pays: In the event of a software malfunction, network disconnection, or hardware failure that disrupts a casino game, all plays and payouts associated with the disrupted session are completely void. Your original stake will be returned to your balance. Betway is not liable for any anticipated winnings that were not fully resolved on our servers due to technical failure.

Live Dealer Conduct: When participating in Live Dealer games, you must maintain appropriate decorum in the chat functionality. The use of profanity, abuse directed at the dealers, or harassment of other players will result in an immediate and permanent ban from the Live Casino lobby.

6. Bonuses and Promotional Terms

Betway frequently offers bonuses, free bets, odds boosts, and promotional credits. All promotions are subject to their specific, accompanying Terms and Conditions. General promotional rules include:

• Bonus Abuse: Betway maintains a zero-tolerance policy for bonus abuse. Bonus abuse will result in the forfeiture of all bonuses and the permanent closure of your account.

7. Prohibited Conduct and Fraudulent Activity

You agree to use the Services solely for personal, non-commercial entertainment. The following activities are strictly prohibited and constitute a material breach of these Terms:

• Utilizing automated software, bots, macros, or AI applications to place wagers, scrape data, or manipulate the platform.
• Attempting to mask or alter your physical location using Virtual Private Networks (VPNs), proxy servers, remote desktop software, or GPS spoofing applications.
• Engaging in arbitrage betting, matched betting across platforms to guarantee a profit, or placing wagers on behalf of a third party.
• Exploiting any software bugs, glitches, or delayed data feeds to gain an unfair advantage over the sportsbook.
• Using the platform to facilitate illegal activities, including money laundering or the financing of terrorism.

8. Responsible Gaming and Self-Exclusion

Betway is committed to promoting Responsible Gaming. We provide integrated tools allowing you to set personal limits on your deposits, session times, and wager amounts. If you feel you are losing control of your gambling habits, you may utilize our "Timeout" feature to temporarily lock your account, or apply for permanent Self-Exclusion.

If you choose to self-exclude, your account will be immediately closed, any pending wagers will be settled normally, and your remaining withdrawable balance will be returned to you. You will be removed from all marketing communications. Betway is not liable if you circumvent your self-exclusion by creating a new account using fraudulent or altered information.

9. Intellectual Property Rights

The Services, including but not limited to all software, source code, algorithms, game mechanics, graphics, audio, UI design, trademarks, and logos (collectively, "Betway Content"), are the exclusive intellectual property of Betway Limited and its third-party licensors. You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to access the Services. You may not copy, modify, distribute, reverse engineer, decompile, or create derivative works based on the Betway Content.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BETWAY EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

BETWAY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR MALWARE. YOUR USE OF THE SERVICES, INCLUDING THE PLACEMENT OF REAL-MONEY WAGERS, IS ENTIRELY AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BETWAY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES.

IN NO EVENT SHALL BETWAY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE TOTAL AMOUNT OF WAGERS YOU PLACED ON THE PLATFORM IN THE SIX (6) MONTHS STRICTLY PRECEDING THE INCIDENT GIVING RISE TO THE LIABILITY.

12. Indemnification

You agree to indemnify, defend, and hold harmless Betway, its parent companies, affiliates, and their respective officers and employees from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your violation of any state or federal law, or your infringement of any third-party rights.

13. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

A. Initial Dispute Resolution

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute, claim, or controversy relating to your use of Betway ("Dispute") informally by contacting our Customer Support team. If the Dispute remains unresolved after sixty (60) days, you may escalate the issue to the relevant state gaming regulatory body (e.g., the NJDGE or PGCB) for mediation.

B. Agreement to Binding Arbitration

If regulatory mediation fails, you and Betway agree that any and all Disputes shall be resolved exclusively through final and binding arbitration, rather than in state or federal court. The Federal Arbitration Act (FAA) governs this provision. The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitrator's award shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.

C. Class Action Waiver

YOU AND BETWAY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. The arbitrator may not consolidate more than one person's claims. If this class action waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void.

14. Modifications to these Terms

Betway reserves the right to amend, update, or modify these Terms of Service at any time. Material changes will be communicated to you via an in-app notification, an email to your registered address, or a forced acceptance prompt upon your next login. Your continued use of the Services after such modifications become effective constitutes your acknowledgment and acceptance of the revised Terms.
